1. Scope of Application

The following General Terms and Conditions apply to all orders placed through our online shop.

Our online shop is intended exclusively for consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.

2. Contractual Partner, Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog.

You can initially place our products in the shopping cart without obligation and change your entries at any time before submitting your binding order using the correction tools provided in the ordering process.

By clicking the order button, you submit a binding order for the goods contained in the shopping cart.

You will receive confirmation of your order by email immediately after submitting it. This confirmation of receipt does not yet constitute acceptance of your offer.

The contract is only concluded when we expressly accept your offer by sending an order confirmation or when we ship the goods to you.

3. Contract Language, Storage of Contract Text

The language available for concluding the contract is German.

We store the contract text and send you the order details and these Terms and Conditions by email. If you have created a customer account, you can view your order details there.

4. Prices and Shipping Costs

All prices are quoted in euros and include VAT. In Switzerland, prices are displayed in Swiss francs.

Shipping costs may apply in addition to the stated prices. The applicable shipping costs will be clearly displayed to you during the ordering process.

5. Payment

The payment methods displayed at checkout are available in our shop.

Depending on the payment method offered, payment processing is handled by the respective payment service provider. The terms and conditions of the respective payment service provider also apply.

If you select payment by credit card, PayPal, Klarna, or another payment method offered at checkout, the payment transaction will be initiated accordingly via the respective provider.

6. Delivery Terms

We deliver to the delivery address specified during the order process.

Information on delivery times can be found on the product pages or at checkout.

Should a product exceptionally be unavailable, we will inform you immediately.

7. Transfer of Risk

If the buyer is a consumer, the risk of accidental loss or accidental damage to the goods passes to you only upon delivery of the goods to you or an authorized recipient.

8. Undeliverable Shipments / Incorrect Address Information

Please carefully check your delivery address before completing your order.

If a delivery cannot be completed due to an incorrect or incomplete address provided by you, and this necessitates reshipping, we reserve the right to charge you for the actual additional costs incurred for the reshipment, provided you are responsible for the incorrect address.

If a shipment is returned to us after unsuccessful delivery attempts, we will contact you to discuss the next steps.

9. Retention of Title

The goods remain our property until full payment has been received.

10. Damage in Transit

If goods are delivered with obvious damage in transit, please report such damage to the delivery driver as soon as possible and contact us immediately.

Failure to report damage or contact us will not affect your statutory rights, in particular your warranty rights. However, your cooperation helps us to assert our own claims against the carrier or transport insurance company.

11. Product Presentation

We make every effort to present our products, colors, and designs in the shop as realistically as possible. However, minor variations, particularly due to different screen and device settings, cannot be ruled out.

Such minor color variations do not constitute a defect, provided the legally required quality of the goods is not affected.

12. Warranty

The statutory warranty rights apply. In the event of defects, you have the statutory rights.

If an additional voluntary warranty is granted for individual products, the details are set out in the respective warranty conditions for the product. Your statutory rights are not limited by an additional warranty. The statutory warranty rights for consumer goods purchases remain unaffected.

13. Statutory Right of Withdrawal

Consumers have a statutory right of withdrawal. Information on the conditions, deadlines, and consequences of withdrawal can be found in our cancellation policy.

The statutory withdrawal period is 14 days.

14. Voluntary Return Policy

In addition to your statutory right of withdrawal, we offer you a voluntary return policy of 30 days from receipt of the goods.

Within this period, you can return items to us without giving any reason.

Conditions for return:

• The goods have only been tried on and not excessively worn or used.

• The goods are in perfect condition.

• All tags are still attached.

Please ensure that the goods are returned in their original packaging or suitable packaging to prevent damage during transport.

Refund:

After receiving and inspecting the returned goods, we will refund the purchase price to the original payment method.

Important Information:

• Returns are no longer possible after 30 days.

• The voluntary return policy applies only to purchases made through our online shop.

• Your statutory rights, in particular your statutory right of withdrawal and your warranty rights, remain completely unaffected.

15. Discount Codes and Vouchers

If we issue discount codes or vouchers, the following conditions apply, unless otherwise stated in the respective offer:

Discount codes can only be redeemed within the specified period and only in the Soulbuddy online shop.

Only one discount code can be redeemed per order, unless we expressly state otherwise.

Cash payment, interest, or subsequent offsetting against already completed orders is excluded.

If you exercise your right of withdrawal or return individual items for an order to which a discount code has been applied, only the discounted purchase price actually paid will be refunded.

If a minimum order value is a prerequisite for a discount code and this is subsequently undercut due to the return of individual items, we reserve the right to charge the difference, provided that this was expressly stated in the respective discount offer.

16. Gift Vouchers

Gift vouchers can only be redeemed in our online shop.

Cash payment of the voucher value or any remaining balance is excluded, unless otherwise stipulated by law.

The statutory limitation period remains unaffected.

17. Use of the Website / Prohibited Uses

You may only use our website and its content within the scope of its intended use.

In particular, the following are not permitted:

• unlawful use of our shop,
• interference with its technical functionality,
• the use of bots, scraping, crawling, or similar automated means without our consent,
• the distribution of malware,
• the infringement of third-party rights.

18. Content, Trademarks, and Copyrights

All content of our shop, in particular texts, images, graphics, logos, designs, and product presentations, is protected by copyright or other legal rights.

Use, reproduction, or distribution beyond the limits of the law is not permitted without our prior express consent.

19. Third-Party Providers / Shopify

Our shop is technically operated via Shopify. However, the contractual partner for orders placed through our online shop is exclusively us, Soulbuddy GmbH.

Third-party providers may be involved for certain technical services or payment processing.

20. Liability

We are always liable without limitation for claims arising from damages caused by us, our legal representatives, or vicarious agents:
• in the event of injury to life, body, or health,
• in the event of intentional or grossly negligent breach of duty,
• in the event of a guarantee promise, insofar as agreed,
• insofar as the scope of application of the Product Liability Act is applicable.

In the event of a slightly negligent breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on which you may regularly rely, our liability is limited to the foreseeable, typically occurring damage at the time of conclusion of the contract.

Otherwise, claims for damages are excluded.

21. Data Protection

Information on the processing of personal data can be found in our privacy policy.

22. Changes to these Terms and Conditions

The Terms and Conditions in effect at the time of your order in the shop apply to your order.

23. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.

24. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR). You can find the link in the legal notice.

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless we are legally obligated to do so.
